I've had my I-140, I-485 pending since August 2007 in Nebraska and i just started getting worried recently when i found out that the job title in the I-140 does not match the job name in my labor cert.
My labor cert took 4 years to be approved and in the meantime my job changed. It is still in the same field/department, in the same company, but it just evolved but still requires the same skills as the labor cert.
I was originally on H-1B and now i work with my EAD. My H1B was amended when my job changed but not the labor cert since we were well into the process when all this happened.
This is really the only concern that i have regarding the approval of my I-140 and I-485. Do any of you know if the job name difference would be a problem for the I-140 to be approved? At the least i hope they would send me an RFE and not deny it right away.

Please post the information here if you filed labor substitution with I-140 in July 2007.

It's too late. BEC already cleared 80% of the cases by now. Only 40000 cases left in BEC as per Oh.

Hi,
I hold a H1B Visa from Company A, which is valid until Sep 2010. I have not used this Visa since the stamping is done.
I am working in India from an X Company and because of the recession and bad job market at US, I did not make use of my H1B Visa.
But now my Employer (Company A) has an in-house project in US. So, I am planning to enter US on my H1B Visa now.
1) What documentation is required to show at the Port of Entry?
2) Since my Visa is going to expire by Sept 2010, which is just 6 months validity, will there be any issues / queries at the Port of Entry.

I am a dependent on an I-485 application, with my father being the primary applicant. The application has been pending since 2001, so I decided to first threaten USCIS with a lawsuit, and then maybe file a writ of mandamus. My question is whether I have authority to do so as a dependent. Can I represent the whole family or at least myself? My father is leaving the country for some time and it will be hard for him to participate in the process.

Kudos to my colleague Elissa Taub who pointed out something rather interesting that none of the supporters of the Arizona law have told Arizonans. Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer. However, the new Arizona law makes it a state crime to be illegally present in the state. I have applied for GC in Aug '07. I recently renewed my H1-B (7th year). I noticed that there is a mistake in the A# of my Green card application (Beneficiary #) on the H1-B approval notice.
Has any one else had this happen? Does any one know what can be done regarding this?
