Your passport has nothing to do with you invoking AC21. AC21 is just a way of informing Uscis that you are switching to another job with similar duties, that's all. There's no official form or application to submit.
Just apply for the renewal of your passport as you would usually do. That's all.

My spouse H4 extension was filed in Jan 2011 and I was under impression that receipt is with lawyer. But recently I came to know that it should come to my address, as of today we have not got receipt no. I am still waiting for H1 approval decision and know H1 receipt no.
Is there way for us or our lawyer to get receipt no. for my spouse's H4 application?

Next year i have my h1b extension with approved i-140 .I am worried about current year pay roll which will be 25k less than mentioned in LCA.Will it be any problem while applying for my extension?

I am...but most of you ain't, so I figured that it made more sense to use an image you'd be more familiar with.

By the ways, there is also a possibility to request retaining old priority date, without filing a second 485.
I assume this is just a request letter from attorney or any representative, if they didn't act on it follow-up with a Service Request.

Guys ,
Here is my situation. greatly aprecite if you could give some suggestions.
I am presently on Non-cap H1b(which is not counted under cap). I am planning to file for H1b thru an employer in april under MS quota with a start date of octber 2008.
My concerns are...
1. How should the new employer file H1b so that I can join at my wish after oct 2008...??
2. My present H1b is valid untill 2010. SHould I be in US while filing and untill my new H1b is approved..??? I ahve plans of visisitng india in March/aprial. So wondering If i need to visit and be back before april or is it ok to travel while my new H1b is filed using the presnet i-94..?? that is trvelling sometime In april/May..???

This might be little bit old, but I dont remember seeing a post on this. Employment-based immigrant visa fees almost doubled, Old fees $ 355, new fees $ 720 from July 13th. Does this mean USCIS will open the gates in Sept bulletin [to be released in August]?

My company has been going through layoffs for the past 3 quarters and are unable to start my GC process. I believe they have to wait for 6 months before they go forward and apply. I am talking about a big company with different departments like operations, marketing and most of the layoffs are happening in these, but recruitment is active in IT. They are regularly recruiting new resources and increasing the head count.
I have following questions:
1) Can my company show that the layoffs are happening in different depts and go ahead and process my GC?
2) What is the risk in doing so.
3) Anyone experiencing a similar situation and could successfully get their GC process started and have approved labor/I140?

Hello Everybody. I am new to IV. Recently I have filed my wife's I-485 (06/28) after my I-485 approval on 06/18. My lawyer said that he has filed it by using the "Follow to join" benefits. He is saying that he cannot guarantee that USCIS will accept the I-485 since my I-485 is already approved. He said that we just have to wait and see until the receipt notice is issued.
Is anybody else in similar situation? Also does any one know what kind of documentation and cover letter needs to be included for this kind of case? I have asked him if he has included the I-485 approval notice and he said "No".

I was checking the http://congress.org
I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.
There are 100s of bills waiting for Co-sponsors published on this website.
I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.
This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.
Any thoughts........

folks, with a lot of effort I got to know the case number of my AEC filed during mid 2001 ( P2002-XXXXX ) (EB3 RIR)
my company did not respond to the NOF due to lack of hiring and layoff's in the company... and then their policy is not to share the case number with the employee...
a standard answer that 'the application will be denied and has been denied' is being given by the HR.
what all can I try to get the status of this application... I have tried to email info@dallas BEC address and they wanted more info and currently awaiting their reply..
what would be the result of such an application? when NOF has not been responded to...
if a case has been denied..will there not be any paperwork from the SWA that it has been denied? or can this case get remanded and go as a TR case (non RIR)?
if anybody has faced something similar let me know... thanks!

In the early 1960s, President Eisenhower worked with the Catholic Church to airlift 14,000+ unaccompanied minors from Cuba to America in an effort called Operation Pedro Pan. In a similar effort, President Obama is working with the Catholic Church to possibly airlift thousands of orphans from Haiti and allow them to remain in the US in a humanitarian parole status. Obviously, this will be a huge challenge and it is always a difficult decision to remove children from their homeland, but the future for orphans in Haiti seems very grim.

Hi,
I am on L1B with I94 expiring on April 2012 from Company X, I found an employer Company Y who will file my H1B in June/July 2011 under premium processing. If H1B is approved then:
1. Can I work under Company X till Sep end and join Company Y from 1st Oct without any hassel?
2. Will my status will change automatically from L1 to H1 from Oct 1st onwards?
3. Will my new H1b will be valid until April 2012 only? as my current i94 (on L1B) is till April 2012?
4. I can travel to India and return in Sep 2011 using my existing L1B? Will there be any problem in port of entry? I have traveled using L1B to-from India multiple times, but I am concerned now because I will be having H1b approved along with L1B.
5. Is there anything special I have to ask the employer before filing H1b so I can go and return from India on my L1b status?

Thats correct. Once the I-140 is denied all the status' that comes with it goes away. So EAD, AP etc are no longer valid. Keep on extending H-1B and if the I-140 ever gets denied then you guys can move to H status.

I completed my Masters degree this May 08 and started working on opt for a company A. Meanwhile another company B filed for my H1 and it got approved. But i would now like to continue working for my current company A.
1. On what status would i be on October 1?
2. Could i continue working for Company A on my OPT even after October 1?
