I have my Perm approved and my PD became current so i'm able to file I-485 but i have a couple of questions.
My fiancee was in US on J1 with 2 year HRR that is not up until Jan 15, 2008. She has been back to the US twice since she left (Jan 15, 2006) on B1/B2 visa. We plan to get married. When should we do it for her to be able to come to the US under my I-485 when her 2year HRR is up.
Please advise. I just sent an e-mail to my attorney but she's on vacation until Jun 19... I guess i'm too anxious to find out what my options are.

I was on F-1 when I applied for I-485 (my wife was the primary applicant). My I-20 expired 6 months back, and I'm working on EAD. I'm planning to travel to India and use my AP for return. Will that be fine ?
What about my I-94 expiry ? I still have a 2 yr old I-94 on my passport, marked F-1/D-S.

The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.
Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.
I will update this blog on the H-1B account as soon as the USCIS makes further announcements.

Hi,
I have an approved I-140 with my current employer. I have an offer from another employer that I am considering but the new employer will only transfer the H1B and not sponsor the GC.
Q1: Can I transfer my visa and start working for new employer and keep the GC process with the old employer if they agree to keep the offer open?
Q2: After visa transfer, if my PD becomes current, can I file I-485 with the old employer while working for the new employer?
I really appreciate any help.

House Speaker Nancy Pelosi today blamed Congress' failure to bring an end to the war in Iraq and deal effectively with the reform of immigration laws as the primary causes of the institution's near-record low approval ratings.
In an interview at the U.S. Capitol, Pelosi said the Democratic takeover of Congress had raised expectations on action to end the conflict in Iraq, and that the Senate's initial willingness to tackle immigration reform followed by its failure to do so left the American public disappointed in Congress.
The House on Wednesday night passed spending legislation that sought to tie funding for the Iraq war to hard deadlines for beginning troop withdrawals, a proposal that has little hope of passage in the Senate.
"People thought it was a problem that could be solved and when it didn't happen I think it was a big disappointment," she said. "Usually those low numbers relate to expectations and there were high expectations" on both Iraq and immigration.
Pelosi made her comments in an interview for washingtonpost.com's "PostTalk" program (http://www.washingtonpost.com/wp-dyn/content/video/2007/11/15/VI2007111501443.html?hpid=topnews), just hours before seven of her party's presidential candidates are scheduled to gather in Las Vegas for a televised debate.
Pelosi said that the heavy wave of criticism directed at Sen. Hillary Rodham Clinton (N.Y.) in recent days stemmed from her status as the frontrunner, not as the lone woman in the race. "I believe that any 'picking on' ... [of] Senator Clinton has to do with her being a frontrunner," she said. "Frontrunners always have to undergo that."
Pelosi, who had a chance to closely evaluate six of the candidates at last weekend's Jefferson-Jackson Dinner in Iowa (http://www.washingtonpost.com/wp-dyn/content/article/2007/11/11/AR2007111101732.html), said that she saw up close that night that Clinton can "hold her own."
Discussing her own rise to the speakership, Pelosi said she did little to emphasize her gender in lining support within the caucus. "The last thing I could have said to any of my colleagues would have been: 'Vote for me because we need a woman in the leadership.'"
On Wednesday night, the House narrowly passed a measure -- 218 to 203 -- that would tie funding for the Iraq war to a specific redeployment plan for the troops in the country.
Pelosi cast the Bush administration's plan to draw down 30,000 American troops from the country as "inadequate," arguing that such a proposal would leave more soldiers in Iraq next year than were there in November 2006.
Citing a story in Thursday's Washington Post (http://www.washingtonpost.com/wp-dyn/content/article/2007/11/14/AR2007111402524.html), Pelosi said that leading U.S. generals have concluded that the stubbornness of the Shiite government in Iraq is causing more problems than al Qaeda or other insurgent groups. "The government is not taking political steps," said Pelosi.
While Pelosi said she hoped the House action would help move the debate forward, she acknowledged that Senate action on the bill was unlikely.
Pelosi sounded a conciliatory note on the current spending showdown with the White House but repeatedly referenced the President's much larger requests for Iraq funding when discussing Democratic priorities like children's health insurance and medical research.
She did, however, express confidence that a deal would be reached with the president on the remaining appropriations bills -- dismissing the possibility of a repeat of the 1995-1996 government shutdown that left House Republicans deflated and President Clinton triumphant.
While admitting that she must do a better job at ensuring the American people are aware of what the Democratic-led House has accomplished in its first 10 months, she expressed confidence that her party's brand was still strong.

The New York Times carried on its front page this morning a Nina Bernstein article that will no doubt cause a shake up at Immigration and Customs Enforcement over what can only be described as a major scandal in the way the agency has dealt with sick detainees at the agency's detention facilities around the country. The details described by Bernstein will no doubt enrage you. The obvious monumental effort Ms. Bernstein put in to bringing this story will also likely move her on to the short list for a Pulitzer Prize for this hard-hitting piece of journalism.

Immigration activists say they are hopeful that Gov. Deval L. Patrick will support proposals in an advisory report calling for more English classes for the state�s immigrants and in-state tuition for undocumented college students. Patrick released the report containing 131 recommendations, which he called a �values� statement, at a luncheon for immigrant advocates.

When you have no GC and are on h1 legally...can you go on a cruise..I do not have stamping on the PP ..the cruise goes to some places in the caribean??..is there a immigration check while comming back??..how does this stuff work...OR is it no GC no Cruise??..

I have a last pay check through an Employer A of August 1, 2008. Earlier before leaving Employer A I filed a H1 transfer to a new employer B and that got approved by USCIS but I didn't start working with Employer B. Now I am getting a new offer from Employer C which is better than Employer B. Attorney of Employer C says that he can file for a transfer through company A as the pay check is less than two weeks.
Now my problem is I not sure whether my transfer from A to C would be successfull or not?
Another thing I have not informed Employer B that I will not be joining him, Do I have to pay him all the H1 transfer fees?

A friend of mine (Indian) is married to an Indonesian. Both are on H1B and have approved I-140s. Can my friend apply for a cross changeability? Does it have to happen when my friends spouse's pd becomes current? or can it be done earlier?

I need some advice here. Actually I have filed two labors.
Company -A - EB3 - PD of March 2003
Company -B - EB2 - PD of March 2006 (PERM)
I got my Labor, I -140 from company B, and applied for 485 recently (July-2nd).
Recently (Last week) I got the labor approved from Company A (as it went to Backlog).
I was thinking that If I get I-140 from Company A then, My layer wants to use that Priority date in already filed 485 case.
But to get the I-140 from the Company B, I may have to spend around 3k, so just thinking if it is worth doing or not.
Any suggestions?

I want to transfer my H1-b from a consultant company to a non-profilt organization which is offering me a full time job. I haven't resigned my job at consultant company yet. The LCA process is going on with new non-profilt organisation and then they are going to apply for H-1B petition soon. I am worried if the consultant company will cancel my visa as soon as I resign and that would cause issues for the H-1b transfer. Please advice when is it safe time to resign and start my new job.
