On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. NO. Read USCIS FAQ
Hi all,
I am resident of CA and have my I140 application approved from Nebraska. My I485 application was filed in TSC. Is this a issue since according to USCIS, CA residents should file in the NSC. Will my I485 will be rejected because of this issue.

I had filled my & my wife's 485 on July 16th 2007. However I noticed that the check that I had sent for my 485 had a minor overwriting in the amount field. I had filed for my wife's H-4 extension last month with a similar issue in the check and the USCIS has sent the H-4 application back. Obviously, I do not want the 485 application to be rejected. So i need urgent help on this matter from you all immigration experts, please help me weigh my options:
1.) Can I refile 485 for me and my wife? Is it possible to have 2 485 applications for a person.
2.) If I refile, and then the USCIS accepts my first application, then will loose the fees for second application or will it be refunded?
3.) Do you think I will simply be asked for another check if I dont refile (which I really doubt.)
I know the mistake might sound stupid but Please guide me in this dilemma. Any help will be greatly appreciated.

How do I post to the monthly contest and keep the pictures in my albums? If I copy the images it posts them again in the "today's photos". Is there a way to post to just your album without them going to "today's photos"?

Friends, Please let me know your input-
Here is my backgound -
1.Current status working on H1B 8th year extension for company A
2.Labor and I-140 is approved � EB3 PD 04/2006 - Company A
3.485 pending applied in August 2007 (> 180 days) - Company A
4.EAD & AP approved - Company A
5.Wife on H4 Status not filed for her 485 as she was not here.
I want do H1b transfer & work for another company B -(Job code & job duties are little different)
I don't want to use AC21 - just continue with Company B on H1 B transfer.
I am doing H1b transfer nothing else once dates are current will add my wife.
Am I doing something wrong or screwing up my GC process?
Please advise

First time poster, long time reader.
I recently received a RFE on my I-140 application for special registration (only apply for men born in the middle east). My attorney and I replied to the RFE letter explaining why I did not register for the requirement. It is been three months since they received my letter (as shown on the e-gov website). I still have not heard anything from USCIS. My status still reads 'RFE: Response Review'
My question is :
Do they always formally reply back to the applicant's RFE response and indicates whether they accepted it or not.? If so, will it be within the 4 month process time.?
Aprreciate any thoughts.

For what it's worth, I was a Nikon pro card carrier back in the '70's. It was a FABULOUS service. I was allowed to borrow expensive gear for free that I would never have used otherwise (e.g. radio-remote release, medical telephoto with built-in ring flash, nikonos)
And the "go the head of the line" repair service saved me more than once. While I was vacationing in California I needed some urgent repairs and was told by the local main Nikon repair shop that their backlog even for "urgent" repairs was 3 months. I flashed my pro card and it was in the repair shop by 10:00 and out by noon!
