    Hello,

    I have recently moved and did an Address update for my I 485 online this weekend. I noticed that there are LUDs on my EAD and AP application (I did not do an address update for these as these applications are not pending, I have received both few months ago).

    Did anyone else experience a similar issue?

    P.S Admins - I tried searching for any similar posts but the verification image doesnt display on my browser and i couldnt get any results. Please feel free to move this thread around or redirect to an existing one.

    Can the IV core group can come up with the webfax to explain our reasonable concerns (to educate the Title V of Senate bill) to all members of congress (House and Senate Members)? This will help us during the conference committee (atleast lawmakers will know our legimate concerns). Also everyone will send fax and will contact lawmakers. Please let us know.

    Hi I'm a Moroccan citizen I was placed in removal proceedings (NY Buffalo) and took voluntary departure. once my wife's divorce was finalized we got married while on voluntary departure. we filed motion to reopen the case and it was reopened and transferred to Los Angeles, CA then the judge closed my case based on marriage with an I130 receipt without prejudice. The I130 was filed on june 2009 and was transferred to Los Angeles on November 12, 2009. I made an appointment with Info Pass but they just said you have to wait untill we call you. My lawyer said I can't file for the I485 untill the I130 is approved. My question is: How long will it take before we will be called for an interview?
    An estimation will be much appreciated thank you very much.

    There is no such thing as AP Renewal, it is always a fresh application. That is the reason application does not mention anything about renewal.

    Reuters talks to Pakistani tennis star Aisam ul-Haq, who made it to the men's doubles finals of the US Open this week about his immigration problems entering the US. He seems to maintain a positive attitude despite being regularly grilled by US immigration officials. Of course, he'll need some luck getting an O-1 or EB-1 approval since he didn't actually WIN the US Open. But that's another rant for another day.

    Hi, my BIL was on H1, and lost his job, then he moved on to EAD, which he hadnt because my sister was on h4, then my sister got a job and went to home country to get it stamped as advised by their lawyer. Now her visa got rejected, maybe bec the company she got the job in is not very big. Anyway now for her to come back, my BIL has been advised to go back on H1.

    My questions are:
    1) How safe is it to go from EAD to H1
    2) Is it true that if you are on EAD and then if you try to go back to H1 the chances of it getting rejected are high? And if your H1 gets rejected then there are chances that your EAD will also get rejected?
    3) How long does it take to move from EAD to H1

    Any insights/suggestions/advises on the above would be greatly appreciated.

    In public, House Speaker Nancy Pelosi (D-Calif.) had done nothing to suppress her frustration as she assented to funding the Iraq war without a deadline to end it. But behind closed doors Wednesday night, she was all business.

    With its members gathered in her office, she told the House's "Progressive Caucus" that she would vote against the war funding bill, but that she also had no choice but to facilitate its passage. Funds were running out for the troops, and she had promised to protect them. The Memorial Day break loomed, and without the money President Bush would have a week to hammer her party for taking a vacation while the Pentagon scrambled to keep its soldiers fed.

    Was she agonized over the situation? Sure, said Rep. Maurice D. Hinchey (D-N.Y.), who attended the meeting. But "we all feel that way," he added. "I feel that way, too. Are we going to just walk away now, or are we going to continue this process, to keep the pressure on?"

    Yesterday's vote to fund the war through September was a historical rarity: the passage of a bill opposed by the speaker of the House and a majority of the speaker's party.

    Two years ago to the day, then-Speaker J. Dennis Hastert (R-Ill.) violated the "Hastert rule" -- that only bills supported by a majority of the majority can come up -- by bringing up legislation to allow federal funding for stem cell research. The majority of the Republican majority opposed the law. He voted against it, but he knew it would never become law over President Bush's signature.

    Over his objections and the opposition of most Republicans, Hastert did allow passage of campaign finance reform in 2002, but only because a petition drive was about to force the bill to the floor. The North American Free Trade Agreement passed in 1993, over the objections of most Democrats, who were then in the majority. But NAFTA did have the support of then-Speaker Thomas S. Foley (D-Wash.), as well as the Democratic president, Bill Clinton.

    In contrast, the Iraq funding bill was not only opposed by the majority of House Democrats, it was also ardently opposed by the speaker and even the lawmaker who drafted it, Appropriations Committee Chairman David R. Obey (D-Wis.). And it is destined to become law.

    "We don't relish bringing a package to the floor that we're not going to vote for," Obey conceded before last night's vote.

    Pelosi's agonized decision put her in the company of Foley, who in 1991 brought to the floor the resolution authorizing the Persian Gulf War and then voted against it, and Thomas Brackett Reed, a speaker in the 1890s who voted against the annexation of Hawaii, and then against the Spanish-American War, but allowed both to go forward.

    "To have the chairman and the speaker vote against a bill like this, I've never heard of it," Hastert said.

    But while protesters outside the Capitol condemned what they saw as a capitulation, Democrats inside were remarkably understanding of their speaker's contortions.

    Party leaders jury-rigged the votes yesterday to give all Democrats something to brag about. A parliamentary vote to bring the Iraq funding legislation to the floor included language demanding a showdown vote in September over further funding. A second vote allowed Democrats to vote in favor of funds for Gulf Coast hurricane recovery, agricultural drought relief and children's health insurance. Finally, the House got around to funding the war.

    Republicans cried foul over what they saw as an abuse of the legislative system, but Democrats saw brilliance in the legerdemain. And with such contortions came more appreciation for the efforts Pelosi was making to fund the war in a fashion most palatable to angry Democrats.

    "It was the responsible thing to do, and she's a responsible speaker," said Rep. Anna G. Eshoo (D-Calif.), who is personally close to Pelosi. "You can't just walk away."

    or should it be filed from Tx where I live and work from home

    This is purely my opinion and may not be the best legal advice. If I were in the same situation, I would go by the EB type (EB2 first) and then by the priority dates. Whichever one is higher, I would apply both in that classification. If both I-140's are EB3 and same priority dates, I would go with the one with better job security (stable employer and job) and keep the other I-140 as backup. In this day and age of corporate acquisitions, mergers and bankruptcies and USCIS backlogs, you want to use the option with the least risk.

    I have a pending I 485 under EB3 I. My wife could become a US citizen early next year. We would like to file another I 485 based on the spouse US citizen catagory.

    Do I have to withdraw the I 485 filed under the EB ?
    I am currently using the EAD & AP derived from the current pending I 485 what happens to them. Do I file for 2 different sets of EAD?

    Please advice..

    Do you know, how one could apply for a Visitor Visa without a Sponsorer in the US ?

    What documents do they need to furnish ?

    As I understand there are a lot of ppl who come to the US who do not have kids/relatives here, what do they have to show if they are just coming to the US for a Visit not work related ?

    I did my MBA in one of the premium universities in USA.
    I applied for H1-B in FY 2008 under master quota from a small consulting company.
    I left US on 30th Sep 2008 as I didnt get an approved petition by that time.Hence I never worked on that approved H1-B petition
    I got a approved petition. I went to New Delhi consulate for H1-B stamping. However I got a Blue 221 G slip. I never submitted any document as the consultant who applied for my visa , needs lots of time to process the documents. In the mean time I got another offer from one of the fortune 500 companies in USA. I am just exploring the possibility of H1-B transfer in this case. Ofcourse they will file a new H1-B application but would I be cap-exempt in this case?

    When you travel on AP carry both the copies. On the PoE the IO will keep one and give the second to you after it is stamped. You use the returned/stamped Copy for your future travel

    When one applies for AP in Multiple entry category they will be given 2 AP dox. lets say if one has used both on travelling like both has stamp of POE can they reuse the same for future travel with in the one year period of validity ?

    Hi everybody,

    I am in pretty awkward situation. i have got my H1b Stamped in august 2008. Did not go to US because of the bad market situation and opted for woking in India. Now my current indian comapny wants me to travel to US on business visa( i have got B1 stamped in 2004 for 10 years) for 1-2 weeks.

    Now i want to know , if i have both the visa stamped( H1b & B1), can i travel to US on business visa without affetcing my H1B visa because i am planning to go US whenever i hear that market is improving.

    Both my wife and I are working on H1B visa.

    We are landing in Canada for H1B visa renewal.

    However, the nvars.com appointment system allows 1 primary applicatnt and then allows to add dependents to that application. Should I add my wife as a dependent or create an independent primary applicant profile for her since she would be requesting an H1 B renewal as well.


    If I create an independent primary applicant profile for her, I may not be able to get the same visa date / appointment for both of us.

    Please guide.

    My wife (H4) & I (H1-B) have valid I94 and visa stamped in out passport for company A until AUG2010.Last September 2008, I have transferred my H1-B to Company B and it got approved and valid until same AUG 2010.Right now I am working for Company B on H1B

    When I moved to company B, My previous employer canceled my I140 that triggered 485 denied (For Both).Worked with a Lawyer and filed MTR and my (I am the primary applicant)MTR got approved back in Nov2008.I am still waiting for my wife MTR update. Online status still shows - Case received and pending. (For MTR)

    1) I am thinking of transfer my wife H4 to Company B. Is there any issue you guys (seniors) think of?

    2) One more question .We both has EAD valid until 09/2010. Both never used EAD. We got our EAD before our 485 denied. Now since my MTR got approved, the EAD is still valid?

    Please let me know. Thanks for everyone help
