Hi
I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?
Thanks in advance for your advice!

I am on L1 visa since May 10, and have plans to switch to H1 without going back to India. My employer is not ready to provide experience and relieving letters, if I dont resign and I cant resign, since I need to pay 5000$.
1) So, does it make a problem while applying for GC, If I dont have these letters from present employer.
2) Inlcuding present company's experience only , I will be able to qualify for EB2 category. But I will not be having letters from my present employer to show that I am having 5 years experience.
Is it must to have experience and reliving letters from all my employers? What are the options for me now? :confused:

My future employer "A" has filed an appeal I290B for denied I140 ("Inability to pay") which is pending at USCIS, however now my current employer "B" wants to file I140 for me. Both of this are on different labor approvals and different job descriptions. Can my current employer "B" file I140 without my future employer "A" withdrawing the I290B appeal? Will filing of I140 by my current employer "B" affect the denial of any of these applications?

Yes he is in 'Adjustee Status' also a person can start working as soon as new employer files H1 petition on his/her behalf. So if the petition was filed on time and took 40 days to be approved your friend was in H1 status since the day the petition was received by USCIS

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

One of my friend's I-485 with priority date of Jan 2006 got approved yesterday. They have posted the documents to USCIS for his wife early this month(as per his attorney) to link to his I-485, but the check was not cashed yet and receipt notice was not issued for his wife.
Will there be any issue in this regard? What will be the options for him just in case if the attorney has not sent the documents to USCIS for his wife or the documents get rejected for some reason? Any help/advice in this regard is really appreciated. Thanks.

I filed my I-485 in Aug�2007 and my I-140 is approved in EB2. My daughter was on dependent H-4 and her I-485 also was filed in Aug�07 as dependent on my GC. She completed 21 year in June�2008.
My question is if we receive our GC in current year, she will get GC as she already crossed 21 years? Appreciate your answer and thank you in advance.
