I have seen references that if there are different I-140 apps approved per family, there is a possibility of going for the 485 stage separately. Also I have seen posts stating that one can go for AOS and the other for CP.
How do you communicate to USCIS that for one you are doing AOS and the other you are doing CP, with reference to the 485 stage? When does this really happen?

yes. it can be done inside USA by filing I-539.
The school must first issue I-20. Then, you can file I-539 with the INS by attaching the I-20.
INS will approve it and return you I-20 along with a new I-94.

New filing fees were applicable from 7/30. Do all applications(485/131/765) whose PD is current need to filed with the new fees starting from 7/30? Or till 8/17 it can be filed with the old fees?

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..
They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.
so should i come to new program..if thats the case how to get an emergency appoitment.

Rescheduling your FP can delay your background check etc., and can complicate your GC approval timeframe. Its better not to reschedule and stick to the appointment unless their is an emergency.
AFAIK, their is no limit on the number of times you can reschedule though, but its advisable not to reschedule for the reasons mentioned earlier..

Hi:
I am a I-485 EB waiter and applied before August 18th. So I have to pay a fee fo 305 dollars. However when I went to check the I-131 instructions for e-filing, i could not find any information if we are eligible to e-file?
has anybody e-filed Advance parole.

Currently I am on H1B visa.I will file my 485 as secondary applicant.What are my options in case If I have to leave my job and my 485 is still not approved.
Do I need to file H4 (Since 485 is still not approved) ?

You can status will be Adjustment of Status ( AOS ) but cant work . IYou need a APO if you want to travel . If you want to work you need an EAD .
Check with attorney .This is the essence of mail which i got from my attorney when asked regarding my son status

Some of my friends who are in their final year of a residency program on a H1b (non profit) have got job offers from profit organizations and their H1b transfer is subject to cap. Their transfer will be done only in May/June 2007 and now they are stuck because of the cap limit.
A lot of people in same situation are IV members. SOme organized effort is required to this cause.
These maybe people who could not file for their "real" jobs when cap was reached.
Must we not start an organized effort and let our law makers know about this situation.

If we lose our job after having the I-485 pending for more than 8 months, I-140 approved, how much time do we have to find another job?
