So, I called USCIS this morning. The lady at the other side of the line told me that I have to reapply, and unless I have a real emergency (as defined by USCIS), I have to wait for another 6-8 months for the AP to be reissued.

After we have filed for 485 and lets say we (me and my spouse) receive our EAD's. If I quit my job after 6 months of filing, can my spouse (secondary applicant) continue to renew her EAD's or would she have problems since I (the primary applicant) is no longer working for the company and maybe working for myself?

I work for company A which sponsored my L1B (my current visa status). Also, few years back company B sponsored my H1B which for some reason I did not utilize (did not even get it stamped) and hence company B cancelled it. Now my questions are -
1. Can L1-B be transferred to H1-B without going through a new visa application?
2. Can the cancelled H1-B be re-instated and utilized?
3. If another company C applies for my H1-B what are the chances of getting it looking at the current work visa regulations and prospective changes? Will my past petition of H1-B cause some issues with consulate?
4. My wife is on L2 and as EAD. Once I file for change of status will the EAD still be valid or it will automatically be void?
Please Help...

Hello All,
My employer is planning to apply for my Green card (labor) next month. My employer has multiple work locations. My employer is going to apply the green card from Washington DC office location but I stay in Delaware and work from Delaware Office Location.
1. Will this impact the process in any way?
2. Do I have to move to Washington DC office to work at any point during the Green Card process? If yes, please let me know at what stage?
3. And if I have to move to Washington DC office to work then do I have to move to stay in Washington DC or can i still stay in Delaware and work from Washington DC?

Company A is willing to give me pre-approved labor. They are willing to file for my I-140 & I-485. They don't expect me to join with them now or immediately after I140 approval. Taking this situation into consideration,
* Do Company A should show the profit equivalent to salary in labor approval, as my case is future employment (Ability to pay)?
* I will for EAD, AP at the same time. Assuming I get EAD in 1 month(Hypothetical), Can I go and work for any employer other than company A, using this EAD?
* If yes, Is there a time restriction, before which I can't join in company B with this EAD?

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. Need suggestion and advise. I recently moved to LA as i found a new job. I do have permanent home in chicago and i m planning to rent a place in LA. Hi
I have one question about the online AR-11 form.
In the online AR 11 form there is one field called Port of entry and there is drop down box which has many items to select the port of entry. This drop down box has two items related to my port of entry.
MA- BOSTON
MA- LOGAN Airport
Are these really two different airports?
I entered US in the Boston Logan Airport (international airport). Which entry I need to select?

I am working on my H1B and on I-140 approved Stage. At the same time I have applied for I-485 as Derivative applicant on my wife's application and also got the Advanace Parol.
If I use the AP (obtained based on wife's application) will my H1B got invalidated? My intention is keep my H1B and to avoid the H1B stamping.

On March 12 2009 I got an query on my I-485.
Requesting discrepancy in the labor applied on Nov'7 2002 and present working place.
My company(abc ltd) applied labor on Nov'07 2002 while I was working at the clients(xyz) place in Los Angeles.
I got my I-140 approved on Feb'15 2006, while I was with the same client(xyz) at that time.
On Dec'04 2006 I moved to Detroit, started working with different client.
RFE goes like this.
The Documentation submitted with your application and/or a review of service records indicate that you no longer reside in the same state or geographical location as the underlying form i-140 immigration petitioner and /or job location specified by your intended permanent employer.
There fore submit a currently dated letter from your original form I-140 employer which which address this discrepancy.
I am still working with the same employer who filed my labor certification.
Any gurus who can suggest me on the query would be greatly appreciated.

This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

My 140 approved in May 07 and I had an LUD on 8-12-07.
AP approved a week ago and I had another LUD on 8-12-07.
I know a bunch of people had similar LUD on their 140s. I am thinking it could be a database issue. No impact..
