I filed my I485 on 31 July 2007.
I have not seen any action on my case. no checks encashed, no ead , no ap ...nothing.

I need to travel to India on 18 Oct, 2007. Can one suggest if it would be ok to travel or shall I postpone my tickets.It has been more than 2 months and I have not received the receipt number. How long shall I wait. I booked my tickets in July thinking that I will be able to travel in Oct :-(

They can incorporate a company but they cannot do any work for it( not even write a check) or take any salary from it. But if the person has an EAD, there are very few restrictions.

As the Visa Dates are current, I want to file my 485 on July1st. Can I file the 485 for my wife and son at a later date(because they are travelling to india on june 16th and will be back on September 1st) or Is it a must that all of three(myself,wife,son) should file for 485 at the same time.
Can I add their names to my 485 later.?
Currently My wife and son(6years old) are on h4.

My H1 stamping has expired. I have traveled using AP before. Just wanted to know if anyone traveled back with AP via Brussels?
Email I received from Belgium consulate just says "Indian nationals do not need transit visa". I am sure it means they do not bother about H1/AP as long as you have legal entry for the destination. Just wanted to re-check.

Right now I am on my 5th year of H1B with company A. If I file for labor with Company B and got approved in a year with out holding a H1 in Company B . can i get 7th year h1 extension with company B as they already have my labor approved? any inputs will be a great help. thanks in advance.

I applied for my EAD and AP extension on AUG 17 2009 and my EAD was expiring on AUG 29th 2009. While my wifes EAD and AP got approved, I had an RFE as I had not sent the recent photographs so I sent that and the receipt date for that was OCT 9 2009.
I continued working and got paid, after speaking to friends I realized, getting paid on a Expired EAD is not right.
I have taken a infopass to discuss this with USCIS to get an update.
One more point I wanted to make was that my payroll company doesn't know about this and doesn't care. But if I bring it up then .they might immediately terminate my employment.
How do I fix this? Please suggest.

I did my Masters and then got a job in Company A who filed my H1b Visa on 10/01/2008 and valid until 07/25/2011.
I did not get stamped yet as i never leave US until now.
Meanwhile my employer applied for amendment as i was put into a project in another state and change in my title .
When i check the status it says "On May 7, 2010, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."
I am going to my country on August 2nd week for my marriage and my questions are.
can i use my current I797 for visa stamping or should i use new I129 which i did not get yet?
can i use the notice as the proof of I129 in case they need it for stamping?
Also could somebody please tell me how long will it take to receive my I129 after the above mentioned status?

Tough talk from the Senate Majority Leader. Some, including my good friend Tamar Jacoby, think this is a really bad idea. I'm not so sure. I think fear of losing the Hispanic vote for a generation or more and the sudden urgency of the situation created by the Arizona fiasco could make responsible Republicans at least seek to block a filibuster and allow for a majority vote (as seems likely with financial regulatory reform). But Tamar is right that we'll get a better bill if pro-business Republicans play a role since some of the overreaching protectionist efforts of the unions...

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.
