I am worried that we would be made to wait for years if they don't have the PD on the application. Why is USCIS working in such an disorganized fashion?

as far as I understand it, you will be eligible for AC21 in feb. As long a they do not withdraw your 140 you should be ok. Just switch to a different employer and invoke AC21 in feb. Disclaimer: consult an attorney to confirm.

Hello,
I'm on OPT since Feb 14 2011. This is my first 12 months of the OPT. I recieved an OPT card from USCIS but I'm not sure what is my valid I-20 at this moment ? Is it the one saying that "OPT is requested" ? I filed a bunch of papers during OPT application but whatever reason my International officer never wants to explain anything to us students and I've to search everything on the internet. I'm applying for a driver's license test and want to know what I-20 would be needed.
Also, my employer is willing to file my H1-B. Should I tell him to file it this year or the next year ? They also signed up for everify recently.
Please suggest.

My labor is approved, but haven't received approval from immigration yet. Online status is showing it is 'CERTIFIED'. Can I file I-140/485 with just electronic confirmation of labor in case if it get delayed in receiving approval? Bwy does anybody have an idea in how many days immigration will dispatch the approval copy of labor after it is certified?

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

Case against his employer had held in the past year and he was doing right to get his right to get the money back so he was not doing anything wrong in the past with his employer but how the new employer of his company react on that background and understand is totally depends upon them but don't worry about it, he was not wrong.

I am in L2 visa right now and I have an EAD to work. I got a job that I need to start on oct 01.
My spouse status will change from L1 to H1B from oct 01, as his employer filled for H1B.
Our L1 & L2 are valid until Aug 2011.
I don't have H4 yet.
What are the various options available for me to work?
1. Can I use my EAD to work which is valid until aug 2011?
2. Can I apply for H1B for me? If yes when I can start working with my H1B.
3. Is there is any way to maintain my husband L1 status until it's validity(Aug 2011) and then switching to H1B after L1 expires?

1) PDs on my I-140 is listed: June 30, 2005 (which became current as of 2/11/2011)
2) I recently discovered a different PD listed on the Request for Initial Interview Notice (for my pending I-485). There is a Priority Date box on this notice letter, and date listed is Aug 16, 2007.
Biometrics done Nov2007
Initial Interview done June 2010
FingerPrint done August 2010
Currently on 3rd EAD
Nationality is Taiwan
Current status: AOS pending

My husband was an employee of a desi company and they had withheld part of his salary, he filed a complaint at the DOL and got the pending money back.. that was 4 years back.. now he is trying to change his job and the new employer wants to do his background check..
what will show up in his background check? will the case against his employer affect him? we are really worried about this.

It depends on, your Priority Date, Country of Chargability and your application's category whether it is EB1, EB2 or EB3.
You can check the monthly Visa Bulletins to see what priority dates for each category are current as of now.
