    I am thinking of applying for 485 right now, and 5 months later for my wife. Do the dates have to current when I apply for my wife. or it does not matter. Has any one done this where they applied for 485 when dates were current but for spouse at a latter date when the dates were backlogged again.

    Depends on what is written in your LC job requirements. If it is either Masters or BS + 5 yrs of experience, then - yes, you can file I140 in EB2.

    I am with H-1 visa. Recently, I help another company finish one project, then I received a stipend of $8K. They will send me 1099 misc form for tax purpose. Does it affect my H-1 status and green card application? Thank you.

    Do you have EAD? If not, you may be in trouble as H1 does not allow you to do a side job.

    I am on H1B visa, and now I am going to fly back to my home country. Unfortunately, I can't find the original left lower portion of my I797, which is "for personal record". I still have the orignial upper portion, I94, and copies of the whole I797 form.

    Will I have trouble getting my visa stamp and reenterring this country? What should I do now?

    Hello,

    Recently I applied for AP. It was approved on Oct 20, 2009 but when I got the document from USCIS I found that the effective date of my AP is from 12/20/2009 to 12/19/2010. My question is,

    1. I want to go to India on 26th Nov and return on 20th December. Some of my friend told me that I can travel between 12/20/2009 to 12/19/2010 not not before 12/20/2009. Is it correct.
    2. My understanding was I can go to India before effective date which is 12/20/2009 and can return on or after 12/20/2009. Is this correct.

    Please respond as I want to go to India on Nov 26th 2009 due to some emergency.

    It depends on which state you are in and where your labor was filed. No matter where you send your application there is a possibility that they can transfer it to another center. I sent mine to NSC and it was transfered to Texas.

    My employer was planning on sponsoring me, and paying all the filing fees, but the deal was that I was going to pay the lawyer directly for the legal fees. I just found out from a second lawyer that technically we can't do that because it will drop my salary below the prevailing wage. Is there anything I can do to get around this, and still pay the legal fees? Is it completely against the law for me to pay them or is that just an "interpretation of the law"? The other possibility is my husband could pay the fees, but I don't know if that's allowed either.

    Let me know if you have any advice - we have to have everything signed by this Friday.
