Hi,
I was an employee with company A till march 2008 and i kept a H1b transfer to
company B on march 24th 2008. I was working to company B for an year
on receipt number applied for h1b transfer at USCIS. I got an RFE with
company B in sept 2008 mean while my I-94 got expired on August 2008.
Company B answered the RFE and submitted to USCIS on October 2008.
After waiting for H1B transfer to get approved it got denied on march 10th
2009.
Now i wanted to change my status from H1b to F1(CPT).My questions are
1. If i apply for transfer from H1B to F1 will i be getting New I-94 from
USCIS?
2. Should i be going back to india for getting stamped after i change my
status to F1 ?
3. Can i be on a student status from the day i receive the receipt notice
from USCIS for change of status ?

Has anyone seen this pattern before for any service center? A "processing times" entry missing? Could this be just an accident, or are they sending the I-140's to another service center? This could mean a LOT to people who sent their I-140's and I-485's concurrently to TSC.

I have this very tough situation.
I have an approved I -140 from previous employer and 6 years is over in USA.
I got a H1B transfer to a different employer last year ( 2009 ) based on this approved I 140 ( H1B was approved around Aug 2009 - given till March 2011 ).
Now I filed for another H1B transfer to another employer. But around September 2009, the previous I 140 was revoked ( this revocation is normal one and not for fraud ). I didn't know about that. So an RFE came for the new H1B transfer since my I 140 was revoked. I don't have a GC on file right now. I had the impression that normal revocation of I 140 doesn't effect H1B transfer. PLEASE HELP!! What are my options?

I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:
Back Ground:
1. My husband and myself are applying for H1 B.
2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.
Q & A:
1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.

Yes , Under certain circumstances. You will either need to qualify for economic hardship, or it should be done via CPT ( it should be offered by your program). Best bet will be for you to talk to your International student advisor.

Therefore, we recommend that EAD and AP renewals be filed 4 months prior to the expiration date, the earliest date USCIS will accept renewal applications. For EAD applications that have been pending for more than 90 days, an interim EAD card can be issued. B1 is purely-non-immigrant-intent visa while H1 is dual-intent. Given this, I do not see any harm entering on B1 while you have a valid I-797 presumably starting Oct 1st? So, after returning you can appear for H1 visa stamp and later enter using H1.

Talk to an attorney he should be able to kiss your employer's ass with lot of things.
If your employer is paying more than what is mentioned in H1B, then you cannot do anything.
If you are working on % basis, then forget about 14k if till you work for him, prorate of H1B pay is paid.
